Terms and Conditions of Use

1. The localphoto� Index (the "Index") is an on- line listing of WWW sites of photographers. localphoto� maintains the Index as a service to the Internet community. Use of the Index is subject to the following terms and conditions. localphoto� may revise these terms and conditions from time to time by updating this posting.
2. The entire content of the Index is copyrighted. You may use and reproduce individual or small selections of listings, provided that you do not make any charge for such use, and do not collect multiple small selections for the purpose of replicating all or substantial portions of the Index. The Index may be displayed by you to limited numbers of persons provided that you do not charge for such use.
3. If you have a site that you want to have listed, or know of someone else's site that you think should be listed, please read the document How to Submit Listings. Please note that localphoto� does not guarantee to include any listing, or to continue to include any listing for any period of time. localphoto� may include or delete listings, in whole or in part, at its sole discretion. localphoto� may edit submitted listings for clarity, brevity or otherwise.
4. Each user of the Index agrees to look solely to the photographer or other information or service provider, and not localphoto�, for any warranty, refund, guaranty, or other claim regarding any order or product or service furnished or ordered. localphoto� does not investigate any of the parties whose sites are listed in the Index, and does not make any guaranty or warranty or assume any liability or responsibility for any such party, nor can localphoto� assist in complaints by any user of any such party.
5. localphoto� will use reasonable efforts to include accurate and up to date information on the Index, but ALL USERS AND PERSONS SUBMITTING LISTINGS AGREE THAT ALL USE OF THE INDEX IS AT YOUR OWN RISK. NEITHER localphoto� NOR ANY MERCHANT, INFORMATION OR SERVICE PROVIDER OR OTHER PARTY LISTED ON THE INDEX, NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE INDEX, SHALL BE LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OR INABILITY TO USE THE INDEX, ANY ERRORS OR OMISSIONS IN THE LISTINGS, OR THE PRODUCTS AND SERVICES OBTAINED BY YOU.
6. This is an offer to provide services, and acceptance is expressly conditioned upon your acceptance of these terms and only these terms. This agreement represents the entire agreement between you and localphoto� and supersedes any and all other communications, prior, contemporaneous or subsequent, and any course of performance or course of dealing, except as modified by a written agreement signed by an authorized official of localphoto�, or by localphoto� revising this posting (provided, however, that any such revised posting shall take effect prospectively from the date of such posting).
7. This agreement shall be in effect from your first use of the Index. localphoto� reserves the right to deny access to any user, however, the disclaimers and limits of liability above shall survive termination for any reason. This agreement shall be governed by the laws of the State of Texas, as a contract made and performed in that state.
